Appellate Court Modifications Extraction consists of, given an Appellate Court decision, identifying the proposed modifications by the upper Court of the lower Court judge’s decision. In this work, we propose a system to extract Appellate Court Modifications for Portuguese. Information extraction for legal texts has been previously addressed using different techniques and for several languages. Our proposal differs from previous work in two ways: our corpus is composed of Brazilian Appellate Court decisions, in which we look for a set of (...) modifications provided by the Court; and to automatically extract the modifications, we use a traditional Machine Learning approach and a Deep Learning approach, both as alternative solutions and as a combined solution. We tackle the Appellate Court Modifications Extraction task, experimenting with a wide variety of methods. In order to train and evaluate the system, we have built the KauaneJunior corpus, using public data disclosed by the Appellate State Court of Rio de Janeiro jurisprudence database. Our best method, which is a Bidirectional Long Short-Term Memory network combined with Conditional Random Fields, obtained an \ score of 94.79%. (shrink)

Olmsted was an influential landscape architect whose works include many parks, recreation grounds and more. Inspired by Romantic and transcendentalist thinkers, he developed ‘pastoral transcendentalism’, a style of designing parks that mimicked natural spaces to reproduce their values within cities. Although environmental justice scholars have pointed out how these designs limit access to parks, I argue that environmental philosophers have not adequately discussed Olmsted, particularly his axiology of nature. Reflecting on it reveals how environmental injustice consists not only of restricting (...) access to nature to protect its essential value – for Olmsted, scenery that could induce a contemplative mindset – but in delimiting nature's value without consideration of how people actually appreciate it. Este artigo apresenta o resultado de uma pesquisa desenvolvida no Programa de Pós-Graduação em Ensino de História da Universidade Federal de Uberlândia (ProfHistória/UFU). Nos limites do texto o objetivo consistiu em apresentar o processo que culminou na elaboração do Curso intitulado “Por uma educação antirracista: o estudo da história da África, cultura afro-brasileira e relações étnico-raciais” produzido como resultado da pesquisa desenvolvida no mestrado profissional, tendo como base e público alvo estudantes jovens e adultos. O estudo está fundamentado em uma (...) pesquisa qualitativa, com revisão bibliográfica em livros e artigos acadêmicos tendo como principais referências autores que realizaram estudos sobre Educação de Jovens e adultos (EJA) e Educação e relações étnico-raciais. Analisamos documentos que regularizam a educação brasileira e as leis antirracistas dedicando atenção especial à Lei de Diretrizes e Bases da Educação (LDB) 9.394/96 e à Lei 10.639/03, alterada posteriormente pela Lei 11.645/08 que estabelece a obrigatoriedade da temática História e cultura afro-brasileira e indígena. Recorreu também a um questionário diagnóstico aplicado aos jovens e adultos estudantes do Centro Estadual de Educação Continuada (CESEC Uberlândia). Conclui-se que para efetivar uma educação antirracista, o ensino de História da África e Cultura Afro-Brasileira não pode se limitar a ações pontuais. É necessário descolonizar os currículos. Cet ouvrage se veut une lecture rhétorique de quelques problèmes-clés ayant marqué la période qui s'étend des débuts de la révolution scientifique du XVIIe siècle jusqu'au moment où, au XIXe, une autre se prépare. Une telle sorte d'analyse se fonde sur le fait qu'avant d'intervenir dans les efforts de persuasion, certains schèmes " poétiques " sont déjà présents et actifs dans la formation et l'acceptation de toute représentation nouvelle. C'est pourquoi la " rhétorique profonde " que nous propose ici Fernand (...) Hallyn ne se contente nullement d'éclairer les procédés de la science qui interviennent dans la communication de positions, de démarches ou de résultats, mais vise d'abord à étudier ses formes d'invention et de découverte. Saisir la démarche scientifique en train de se faire comme un cas particulier de la problématique générale de la créativité - bref explorer plus avant la voie ouverte dans La Structure poétique du mande - tel est donc l'enjeu de ce volume. This paper intends to explore whether and how the quality of participation experiences is associated with political efficacy and the disposition of migrant and non-migrant young people to becoming involved. The sample includes 1010 young people of Portuguese, Angolan and Brazilian origin, aged between 15 and 29 years old. The results reveal that the quality of participation experiences is related to political efficacy and dispositions to becoming involved, but different groups seem to react differently to different forms of political action.

David Albert explains why we can typically influence the future but not the past by appealing to an initial low-entropy state of the universe. And he argues that in the rare cases where we can influence the past, we cannot use this influence to knowingly gain future rewards: so it does not constitute control. I introduce an important new case in which Albert's account implies we can not only influence the past but control it: a case where our actions in (...) the present are reliably correlated with several events in the present and past. To deal with such cases, we need to appeal to epistemic conditions on deliberation: being agents requires our decisions being epistemically undetermined at the time we make them. In a world with the past-hypothesis, this implies that deliberation will typically come prior to decision. Once deliberation in this direction is established, correlations towards the past cannot then be exploited for control. To explain why we cannot effectively control the past, we need to appeal to deliberation, whether as part of a defence of Albert's account, or used independently to explain the asymmetry of control. Entre la abadesa medieval alemana Hildegard von Bingen (siglo XII) y la monja clarisa chilena de fines del siglo XVII sor Úrsula Suárez existe una gran distancia histórica y cultural. Sin embargo, algo las aproxima enérgicamente, tal y como si hubieran sido hermanas del mismo claustro. Y esta aproximación no consiste en la vestimenta de hábitos o la proclamación de votos de pobreza, obediencia y castidad, si no que es, por sobre todo, la peripecia que ambas tuvieron que realizar para (...) poder relatar sus experiencias espirituales: pedir el permiso de una figura masculina en el caso de Hildegard, y someterse a la obediencia de esta misma figura en el caso de Úrsula. En este trabajo me propongo exponer cómo los discursos de las monjas que han escrito se subordinan a la aprobación de un modelo de poder y autoridad. Among the medieval German abbess Hildegard von Bingen (XII Century) and the Chilean late seventeenth century Clarisse Sister Ursula Suárez there exists a great historical and cultural distance. However, something strongly approximates them as if they were sisters of the same cloister. And this approach is not the clothing habits or the proclamation of vows of poverty, obedience and chastity, but it is, above all, the adventures that both had to live through in order to describe their spiritual experiences: ask permission of a male figure in the case of Hildegard, and submit to the obedience of this same figure in the case of Ursula. In this paper we propose to show how the discourses of the nuns who have written are subordinated to the approval of a model of power and authority. (shrink)

Neste artigo é defendida a tese de que a noção aristotélica de perfeição silogística não é completamente arbitrária e reflete características lógicas, apesar de alguns aspectos não lógicos. Em consonância com a sugestão de alguns intérpretes de que a validade dos silogismos em primeira figura se fundamenta no dictum de omni et nullo, será apontado como essa fundamentação se desdobra em procedimentos dedutivos encontrados nos textos de Aristóteles. Tomando definições ou explicitações das proposições categóricas como parâmetro, a perfeição ou imperfeição (...) de um silogismo, independentemente das relações de prova que se adote entre as figuras silogísticas, não se mostra arbitrária. El texto aborda la vigencia del pensamiento educativo de Paulo Freire. Parte de la crítica sin sustento que se ha hecho a la propuesta de Freire, por parte del gobierno actual de Brasil. Se rescatan conceptos medulares que, a pesar de haber sido creados hace algunas décadas, sirven para entender y actuar ante los problemas sociales, políticos, culturales y, por supuesto, los educativos; que aquejan actualmente al mundo. La deconstrucción es necesaria en un ambiente de injusticia y violencia, también porque (...) las _fake news_ prevalecen hoy día, sin examinar la veracidad de lo que difunden sobre la obra de Freire. Educación de adultos, praxis, derechos humanos, democracia, diálogo, educación liberadora, opresor-oprimido, etc.; son algunos de los conceptos que pueden rescatarse y ponerse en conversación junto con la influencia que ejercieron en Freire diversos pensadores. El pensamiento de Freire es integrador, que no ecléctico, de ahí la complejidad de su pensamiento. Todo esto fue plasmado en obras como Pedagogía del Oprimido, Pedagogía de la Esperanza o Pedagogía de la Autonomía. Releerlas cobra relevancia, si como educadores... “No renunciamos a nuestro deber de dejar este mundo un poco mejor de lo que lo encontramos. Ese debería ser el sueño de todas las personas. For many years, the game of chess has provided an invaluable task environment for research on cognition, in particular on the differences between novices and experts and the learning that removes these differences, and upon the structure of human memory and its paramaters. The template theory presented by Gobet and Simon based on the EPAM theory offers precise predictions on cognitive processes during the presentation and recall of chess positions. This article describes the behavior of CHREST, a computer implementation of (...) the template theory, in a memory task when the presentation time is varied from one second to sixty, on the recall of game and random positions, and compares the model to human data. Strong players are better than weak players in both types of positions, especially with long presentation times, but even after brief presentations. CHREST predicts the data, both qualitatively and quantitatively. Strong players' superiority with random positions is explained by the large number of chunks they hold in LTM. Their excellent recall with short presentation times is explained by templates, a special class of chunks. CHREST is compared to other theories of chess skill, which either cannot account for the superiority of Masters in random positions or predict too strong a performance of Masters in such positions. O objetivo deste artigo é prosseguir a reflexão sobre as diferentes questões que compõem o pensamento ético de Hans Jonas, cujo ápice coincide com a publicação do célebre Princípio responsabilidade (1979), como resultado das décadas de estudos voltados para temas, antes excluídos da discussão ética, como a natureza e a técnica. De fato, natureza e técnica são dois importantes temas presentes no pensamento jonasiano posterior ao estudo da gnose e preparam o caminho para a reflexão ética posterior. Trata-se, portanto, de (...) discutir a forma como eles estão ali relacionados e extrair daí algumas consequências relevantes para melhor compreender o conjunto da obra jonasiana. (shrink)

In the past years, many students had problems with their finances, especially their expenses for education. Many of the students are affected by the crisis financially, emotionally, and by their wellbeing. That is why the government provides programs that will help the students with their problems with school expenses, and that is through the Tertiary Education Subsidy (TES) of the Commission on Higher Education (CHED). Further, the primary goal of this study is to explore the TES Grantees' lived experiences, challenges, (...) and coping mechanisms. Furthermore, these are the study's findings: (1) The grantees find the TES very helpful regarding finances that will tackle their academic needs, such as tuition fees and school learning materials. (2) Many students value government assistance that motivates them to maintain their grades. (shrink)

What is ‘counterintuitive’? There is general agreement that it refers to a violation of previously held knowledge, but the precise definition seems to vary with every author and study. The aim of this paper is to deconstruct the notion of ‘counterintuitive’ and provide a more philosophically rigorous definition congruent with the history of psychology, recent experimental work in ‘minimally counterintuitive’ concepts, the science vs. religion debate, and the developmental and evolutionary background of human beings. We conclude that previous definitions of (...) counterintuitiveness have been flawed and did not resolve the conflict between a believer’s conception of the supernatural entity (an atypical “real kind”) and the non-believer’s conception (empty name/fictional). Furthermore, too much emphasis has been placed on the universality and (presumed) innateness of intuitive concepts (and hence the criteria for what is counterintuitive)—and far too little attention paid to learning and expertise. We argue that many putatively universal concepts are not innate, but mostly learned and defeasible—part of a religious believer’s repertoire of expert knowledge. Nonetheless, the results from empirical studies about the memorability of counterintuitive concepts have been convincing and it is difficult to improve on existing designs and methodologies. However, future studies in counterintuitive concepts need to embed their work in research about context effects, typicality, the psychology of learning and expertise (for example, the formation of expert templates and range defaults), with more attention to the sources of knowledge (direct and indirect knowledge) and a better idea of what ‘default’ knowledge really is. This study examines the impact of a social desirability response bias as a personality characteristic (self-deception and impression management) and as an item characteristic (perceived desirability of the behavior) on self-reported ethical conduct. Findings from a sample of college students revealed that self-reported ethical conduct is associated with both personality and item characteristics, with perceived desirability of behavior having the greatest influence on self-reported conduct. Implications for research in business ethics are drawn, and suggestions are offered for reducing the effects (...) of a socially desirable response bias. (shrink)

Chile’s recent history has gone through a hybrid conjuncture between what has been called the “social outbreak” on October 18, 2019, and the declaration of health emergency by COVID-19 promulgated on March 18, 2020. In such a context, this article describes and interprets two presidential speeches that announce the States of Exception based on conjunctural enemies’ rise. This social problem is investigated from Critical Discourse Studies and Systemic Functional Linguistics, particularly the appraisal system, together with the categories of legitimation proposed (...) by van Leeuwen. This research is positioned from a qualitative perspective and takes as a corpus of analysis the two speeches declaring a State of Exception by President Piñera in 2019 and 2020, respectively. These speeches are available to the public at https://prensa.presidencia.cl/. The results show that an enemy is constructed in both cases by contrasting the actions taken or not, which present negative appreciation valuations in the case of COVID-19 and negative integrity judgments in the case of the social outbreak. In both cases, key social actors emerge that are firmly legitimized within the State of Exception framework, which in turn is based on the categories of authority and moral legitimation. In conclusion, the enemy’s construction is identified in both cases with modification of the actors that interact through a problem, an action, and an agent that solves the problem constructed. El presente artículo desea reflexionar, por un lado, sobre la necesidad de una formación integral de los agentes sanitarios, que contemple la dimensión espiritual; y, por otro lado, sobre la necesidad de una mejor preparación de los agentes religiosos que trabajan en hospitales y centros de salud, para que en sus intereses y preocupaciones por los enfermos, se eviten las dicotomías en nombre de la fe o en nombre de la razón. La promoción del diálogo entre razón y fe reduce (...) la distancia entre las ciencias y evita el divorcio entre la praxis de la fe y la praxis de la ciencia, revelando que, a pesar de ser distintas por sus grados de certeza, pueden estar próximas por el objeto: la búsqueda de la verdad que libera al ser humano de todas las formas de injusticia y opresión, generadoras de malestar y enfermedades sicosomáticas. This paper intends to reflect, on one hand, the need for an integral education of healthcare agents, that addresses the spiritual dimension; and, on the other hand, the need for a better preparation of religious agents that work in hopitals and health centers, so that, in the interest and concern for sick people, dichotomies in the name of faith or in the name of reason are prevented. The promotion of dialogue between reason and faith shortens the distance between sciences and avoids a divorce between praxis of faith and praxis of science, showing that, despite the different degrees of certainty, may be close by the object: the search for the truth that liberates human beings of all forms of injustice and oppression, disease generators and psychosomatic illnesses. Understanding how look-ahead search and pattern recognition interact is one of the important research questions in the study of expert problem solving. This paper examines the implications of the template theory Gobet & Simon, 1996a , a recent theory of expert memory, on the theory of problem solving in chess. Templates are chunks Chase & Simon, 1973 that have evolved into more complex data structures and that possess slots allowing values to be encoded rapidly. Templates may facilitate search in three (...) ways: a by allowing information to be stored into LTM rapidly; b by allowing a search in the template space in addition to a search in the move space; and c by compensating loss in the minds eye due to interference and decay. A computer model implementing the main ideas of the theory is presented, and simulations of its search behaviour are discussed. The template theory accounts for the slight skill difference in average depth of search found in chess players, as well as for other empirical data. (shrink)

In a famous study of expert problem solving, de Groot (1946/1978) examined how chess players found the best move. He reported that there was little difference in the way that the best players (Grand Masters) and very good players (Candidate Masters) searched the board. Although this result has been regularly cited in studies of expertise, it is frequently misquoted. It is often claimed that de Groot found no difference in the way that experts and novices investigate a problem. Comparison of (...) expert and novice chess players on de Groot's problem shows that there are clear differences in their search patterns. We discuss the troublesome theoretical and practical consequences of incorrectly reporting de Groot's findings. (shrink)
